LEGISLATIVE GOALS

Booth Rental Licensing

It is the goal of this association, to pass legislation that will require all booth renters to register and obtain a license as a salon.  The salon in this instance is the particular "booth" or "chair" used by a cosmetologist, nail technician or a skin specialist for working on clients.  Each "booth" or "chair" will be considered a free-standing salon and shall be held to the same requirements as a licensed salon.  Learn more...

Product Diversion

FAB has requested the help of the entire industry to come together to form a Product Diversion Task Force.  The Task Force will look into Florida's current legislation that deals with diversion of drugs and cosmetics and how it may affect our current situation.  FAB is answering the call of its members and the consumer to bring confidence back to the salon professional product.  Learn more...

Tax-Tip Credit For Salons

FAB Professionals will work with other national associations to lobby the Federal Government for Tax-Tip Credits for the beauty industry, much like the existing tax-tip credit currently in place for the restaurant industry.

  • This expanded credit is a matter of fairness and common sense.  Like the restaurant industry, salon owners must collect and report tip information form its employees to the IRS and pay FICA taxes on the reported tips.  Unlike the restaurant industry, salons cannot claim the tax credit for FICA taxes paid on tips.
  • The tax-tip credit will ease the financial burden of tip reporting.  Salon owners are faced with an onerous task when it comes to tip reporting laws.  They must educate employees about tip reporting laws, do their best to ensure employees are complying with the law, keep records of reported tips, and report the income to the IRS.  A tax-tip credit for salons will bring needed tax relief to salon owners and help offset the resources used to comply with tip reporting laws.
  • This type of legislation will help improve income reporting within the industry.  The support of booth licensing plays a significant role as we move to support the tax-tip legislation.  In most industries where tipping is customary, the individuals being tipped are employees.  There is a significant self-employment segment of the salon indjustry.  As we know, two salons may look alike but they can be structured differently as it relates to employees and independent contractors (booth renters).

Educational Increase in Hours

FAB Professionals is actively working on a two-phase process (voluntary and legislative) of increasing hours of education for cosmetologists, estheticians and nail technicians and providing to our member schools the ability to certify their estheticians and nail technicians by a national examination.  Learn more...

 

INDUSTRY STATEMENT:

FAB Professionals has established a terrific reputation with Florida's Legislators and Regulators.  The association's involvement in the 2007 and 2008 Legislative Sessions gained FAB Professionals political clout and backing from lobbysits, senators and representatives.

FAB has developed a working relationship with the Department of Business and Professional Regulation (DBPR), the Department of Education's Commission for Independent Education (CIE) and the Deparment of Health (DOH).  These relationships provide members with a direct line of communication with their regulators.  FAB is able to provide assistance in initial licensing, licensing renewal, continuing educaiton and other regulatory issues.  This, alone, is a huge benefit to members.
